View Full Version : Public road and highway defects (who's to blame?)

Heya people,

One of our members, Sho, hit a rather large pothole on the I-5 (please use caution... hopefully he'll post specifics on location but I believe it was near San Clemente area).

It was so bad that his front rim got mashed causing his front tire to lose air. His rear rim was dented as well.

Since I didn't know the answer to his question other than somehow calling the city to get them to pay... anyone know what to do in such a case?

Perhaps call his insurance agent and have them deal with the city instead somehow?

just suck it up and buy new rims off ebay


really sucks, but i wouldnt go through insurance, i rather call the city on my own or just suck it up

Hmm... what' s wrong with calling insurance? They can't raise your premiums if you do not make a claim and there is no reason for them to do so in the first place since such a thing is not the fault of the citizen getting nearly killed due to a public road defect? Or is it?

Anyone know the procedure for this?

Unless he doesn't want a claim on his record, it's not worth it to file one. Best thing he can do is call the city of San Clemente and make a complaint. Same situ happened on my car when the city of oceanside was repaving the road, they had half of the street half finished leaving a really big step(they didn't even put a sign or a ramp). I hit that bump in my FNF riced out Integra bending both front rims. I tried filing a claim to the city of oceanside making them pay for a set of new rims. Took 6 months and still heard nothing. I eventually bought them to a rim repair shop and got 'em looking 99% new for under $100. The city only takes action if injuries were involved or more than one person files a claim.

Wow.. dang that sux. Well our fellow member here is pretty strapped for cash so I was hoping i could help him get it covered by the city somehow and have the insurance agent work the claim against the city if possible.. figured that would be like one of the reasons people buy insurance in the first place? I would think that we are paying them to do this for us... oh well. =T Thanks for the info.... if anyone else's got input or experience with this, please do share!

well we could get a petition about the spot, or have people call and complain. maybe that might prompt a response if he makes a claim

I believe this is not covered by the city. The I-5 is maintained by federal officials. http://www.dot.ca.gov/
More specifically, San Diego is District 11: http://www.dot.ca.gov/dist11/

Here's the info I used to request the repairs:
it's on the 5, south bound, in Orange County near Capistrano Beach.
The nearest intersection is camino las ramblas. I hit the step between 3 and 4PM. The type of maintenance service is "Rough, Broken Pavement".
The break in the pavement is a step about 3 inches tall and is in the third lane from the center, not including the carpool lane.
