Where the 57 and 5 carpool lanes merge. I passed a big work truck that was hogging the right part of the lane on the right shoulder. I just came out of the white line for the pass as I always lane split within the lane and there was a popo there who saw it. It was a motorcycle cop who was off his bike and waved me over to where he was.

It's illegal and all, I know... but it was just lame. Traffic was at an almost complete stop (walking would be faster) and I was lane-sharing super slow too... around 15-20 mph... and within the lane except for the pass on the truck.

What's even more lame is that I've motorcycle cops on the same exact place "lane share" on the shoulder the WHOLE way. Frickin hypocrites.

usually cops on the shoulder are responding to an accident. Which is probably what is causing the traffic anyway. Whoa! did i just defend a cop? Wow, these meds are good.

sorry to hear that my friend, I had rough first few months here realizing the biker cops prey on riders. They took me for license plate and signals once, but he was nice about it.

got pulled over again after I came back from Japan for the same thing and the jerk told me he could still give me a ticket even though it was in my grace period causing me to have a misdemeanor on my record (TOTAL BS). How was I supposed to fix it when between the first and second stops I was in another dam country??

anyway that jerk gave me a ticket for earphones instead, such a chicken sh*t! He was just mad he had to work on a saturday and I was out to get me some when he wasn't!

I am taking this one to court to see the look on the judges face when I bring such a dumb worthless ticket in front of him; he will know then that the CHP is just a ****.

That sux, i've used the shoulder a couple times... it's only illegal if you get caught...

I'm not talking about ones w/ sirens blaring and going fast. These dudes just cruise on the shoulder to do the same exact thing I'm doing -- just getting past traffic

Oh, and the LEO tried to give me a ticket for wearing headphones (I was listening to my mp3 player) and he said you were only allowed one in the ear. I told him that that was not the case and that I had it dismissed in court a while ago. However, he showed me the CVC and it was updated (2005-06) that confirmed what he had said. He was very patronizing about it, but i was like whatevers :rolleyes: That was interesting though that it's in the CVC

awww a freakin headphones ticket, that sux. so how did he know u had them in both ears? did u take off ur helmet or what. i just got pulled over last nite for doing 49 in a 45 mph zone and having a blown out lite over my license plate on my 1990 dodge p.o.s.. i had no license, no registration or insurance on me. i had just came from the gym and didnt even have a shirt on and was all sweaty. bet i looked like a tweaker. I saw him at the light passed by the cop and proceeded to drive on, my back window is so dirty i didnt realize that was him in the ford explorer. but the cop was cool and let me go since i had a clean record. whew

I was coming up 67 from far a$$ Ramona and when the traffic got thick I started passing cars slowly on the inside of the white line (separates the shoulder from the lane). The guy on the FZ1 right behind me instantly takes the shoulder and nails about 60 passing everyone.

I didnt do this because I didnt know who was going to get a ticket (or a bigger one) and I stay out of the shoulder because that is where all the nails, rocks and road debris falls.

Can anyone tell me who was wrong here?

Just stay off of the shoulder. Its illegal, were lucky enought to get to lane split.


Sorry, but the reference about "pigs" is just uncalled for. They are out there doing a job most of us would not do. Sometimes it may seem unfair when we get a ticket, but were also the first ones to say that they don't do enough. If you got a ticket for doing something illegal, man up..

i was not splitting lanes, but i was sharing a lane with the cars

I actually asked a group of police when i was downtown last week about lane splitting and was directed to ask the Traffic Sergeant there in the group. He informed me that lane splitting was not legal in any situation, however it is overlooked in safe conditions.

thats cr*p, dont ask the cops because their feeling is "if you have to ask, you shouldn't be doing it"

CA is the ONLY state it is legal in, the ONLY STATE.

I think Wanderer needs to settle this thread.

Just keep in mind safety, if you split a lane, any cop can give you a ticket if they think you are splitting lanes, or lane sharing if you wish to call it that, in a situation that is unsafe to do so, kinda like going the speed limit in the rain if the conditions call for a slower speed, you can get sited, it happend to me before!! What it comes down to is what the cop percieves is safe or not for the conditions of the road, that is why the law is so grey!

Writing traffic tickets brings in funds for the city, they just turn around and hire more cops.

There is benefit to them writing tickets, not for saving my a$$ when I had a gun stuck in my face years ago.

I think the more politically correct term is "mobile secretaries" because they are just there to write the public tickets and rake in $. When someone almost gets shot, they are just there to write the report and give you a case number in case you want to sue anybody.

I had a feeling he was full of crap... my reason for asking a cop was because i was splitting down miramar a few weeks ago and a car pulled, from the center turn lane, infront of me and stopped because the traffic would not alow him to get all the way through. I had to do an emergency stop and ended up with my back tire in the air... i came within inches of hitting him and my bike ended up on its side due to loss of balance. i was not injured, just lost my mirror and got a few scratches on the fairings, however i didn't feel it was serious enough to involve insurance and figured i might be at fault for lane splitting... it was killing me to find out if i would have really been at fault... now it sucks to think that the cop was not telling me the truth...

I will probably go to court and see if they will at least reduce my fine as I heard it is a $300 ticket -- frickin lame

get you a book about beating traffic tickets and CA traffic laws.

make an overhead diagram and show what happened and why you think the ticket was unnecessary.

Things can only look better if you go to court, just make for the judge worth hearing.

i don't care what the chp dmv site says. NO WHERE in the CVC (california vehicle code) is lane splitting/sharing mentioned. what robert says holds true. safe and prudent. MUCH grey area. MUCH officer discretion.

the officer didn't lie. it's not legal. it's not ILlegal. while you're lane sharing if you happen to "split" lanes you're breaking like 8 infractions with the worst being reckless operation.

i'd say to just use common sense but that doesn't appear to be too common these days.

jeff, always fight your tickets. it's your right although it's NEVER ok to pass on the shoulder so you are probably SOL on this one. emergency vehicles only.

i see LOTS of people sharing or weaving at high speeds. pretty insane if you ask me. if you do that and something happens, you pretty much are begging for something bad to happen to you.
