View Full Version : Got a simple ticket...can I beat it?

I got a ticket in my truck for speeding..."80+ in a 65". I was just going with the flow of traffic. anyway, the ticket had me as the registered owner also...the truck isn't registered in my name. is that enough to get it thrown out.

they ticketed YOU!

yea, safest bet would be traffic school. a judge is not gonna care if a little info on the ticket is incorrect. as long as the ticket was to you and your name's on there, it's fair game.

This one is a little iffy guys.

My aunt got out of a speeding ticket because the cop wrote down the wrong color of her SUV.

I've also read that people have gotten out of those red-light cameras because the camera system "sensed" them in a different lane. ie (lane 1 vs lane 2)

You might wanna speak with a traffic law pro about this one.

If the out is related to the citation, Charlie, I think you'd be right. Having an invalid color of the SUV and stating the wrong lanes on the citation goes to having an accurate depiction of the infraction. However, the wrong name of the registered owner does not seem related to going over the speed limit.

Talk to a law professional as that's your right. However, if this is your first citation, just see if you can go to traffic school and call it a day unless you have a better argument to fight the ticket.

im not an expert... but i have had many of tickets and can say that i have zero on my actual record! from the time you get the ticket and your due in court.. .you can ask for an extension [30 days] you will then go in and plead guilty or not guilty, if you plead not guilty they will give you another court date as your standing there. You can say you cant make that day and push it back...
from then its usally been around 2-3 months from the time you actually got pulled over, if the cop shows up and you feel that you dont have a case you can change your plee to no contest and ask for traffic school! and then your no worse off than you were previously... [and you have the chance that the cop wont show up]
and about the wrong name as the registered owner i agree that I dont think it will matter...:errf:

p.s. it is not a written rule that you can only do traffic school once in 18 months... its just more something that judges go by! it totally depends on the judge you get... [ive done it 3x in one year] and then theres class 2 traffic school for 18 hrs and $120.00...

but the cops get court days scheduled on their days off to get overtime or double pay just to sit at court . thats why the courts want 45 days to schedule the court date.

Fight that ticket!!! If you lose, you can still do traffic school! Check out ticket assassin.com
If you were going with the flow, you have a legit excuse. There is a law in the books that deals with traffic safety and applies to traffic flow.
First thing is to fight the ticket by mail, if you are still found guilty, then you can appeal and demend a second trial (Trial de Nuvo) and have you case tried again.
Also, how was your speed determined? Radar or pace. If it is radar, then it makes things harder. If it is pace, then you have a better chance of getting off, especially if the officer failed to produce his unit number (crusier) on the ticket. There is no way to verify the speed of his vehicle was accurate, hence your speed would be inaccurate.

Being able to get out of it really depends on the specific citation. If it is basic speed law then you can get out of it. Basic speed law says that you must travel in a manner that is safe and prudent for conditions. If traffic is going 80 mph and you are doing 60-65, that is not safe. You become a rolling road block. They are asking you to break one law to abide by another.

What was the specific violation number?

Read this thread on the SV forum, Nukleon has a GREAT history of fighting tickets, avoiding traffic school in the process.

alright I'm convinced. I'm gonna do trial by mail and try to call out the basic speed law. I wasn't going any faster than traffic.

I got out of a 43 in a 25 under vehicle code 22350 based on that code not specifying that the posted speed limit defines what's safe and prudent. Under prima facie speed (vehicle cod 22352), the safe speed, as defined by the posted speed limits, are clearly defined. In your case, you were likely cited for vehicle 22349 which states you cannot go faster than the 65 mph speed limit (55 in rural highways), except where the 70 mph speed limit is posted. Thus, your out under Vehicle Code 22350 doesn't really work if you're trying to get out based on the letter of the law. If, however, you want to get out of it based on the spirit of the law, you better have a stronger argument than just saying everyone else was driving as fast. You would probably need to get records of a highway survey of the area you were ticketed at to support that as well as whatever else it takes to corroborate you weren't being blatantly doing something you weren't supposed to be.

One thing I told a friend of mine who got a ticket in her truck on the freeway was to fight the ticket in the mail and say that her husband just put bigger wheels and tires on her truck and she didn't realize that the speedometer was off as a result. While that didn't work to get her out of the ticket, they did agree to reduce the fine or administrative cost to go to traffic school and she was happy with that.

I'm definitely no replacement for legal counsel. Just know that some of the information you need to fight your ticket is out there if you look hard enough. Vehicle codes are published online.
